Introduction
Welcome to Release Notes AI ("the App"), a Jira app provided by Rogue Wombat Software ("we," "us," or "our"). These Terms of Service ("Terms") govern your use of the App, which enhances your Jira experience by delivering concise, AI-powered release notes from sets of issues in a release through a secure integration with OpenAI. By installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not install or use the App.
We’ve built Release Notes AI with your productivity and security in mind, leveraging Atlassian Forge’s high standards to deliver a reliable and trustworthy service.
Eligibility and Account
Eligibility: You must be at least 18 years old and have the legal capacity to enter into these Terms to use the App. By installing the App, you represent that you meet these requirements.
Jira Account: The App operates within your Jira instance via Atlassian Forge. You need an active Jira account to install and use it, subject to Atlassian’s terms (Atlassian Terms of Service).
Paid License: The App is a paid service via Atlassian Marketplace. You must maintain an active subscription to access its full functionality.
License and Use of the App
License Grant: Subject to these Terms and an active paid subscription via Atlassian Marketplace, we grant you a non-exclusive, non-transferable, revocable license to use the App within your Jira instance for its intended purpose: generating AI-powered release notes from sets of issues in a release.
Restrictions: You may not:
Copy, modify, distribute, or reverse-engineer the App.
Use the App for unlawful purposes or in violation of these Terms.
Attempt to bypass licensing restrictions or access features without a valid subscription.
Share or resell the App’s functionality outside your licensed Jira instance.
Subscription and Payment
Paid via Atlassian: The App requires a paid subscription purchased through Atlassian Marketplace. Subscription fees, billing cycles, and payment terms are managed by Atlassian per their policies (Atlassian Billing Policies).
License Verification: We use Atlassian’s licensing API to verify your subscription status. Without an active license, the App will display an error and restrict functionality.
Changes: We may adjust pricing or subscription terms via Marketplace updates, with notice provided through Atlassian’s channels.
Your Responsibilities
Jira Data: You grant us permission to access and process Jira issue data (issue key, summary, description, comments) for issues within a release to generate release notes, which are sent to OpenAI’s API using our securely managed OpenAI key.
Compliance: You must use the App in compliance with applicable laws, Atlassian’s terms, and OpenAI’s terms (OpenAI Terms of Use).
Data and Privacy
Data Handling: We collect and process data as outlined in our Privacy Policy, including Jira issue data, all securely stored and encrypted in Atlassian Forge Storage. We do not own your data—it remains yours.
OpenAI: Release notes are generated via OpenAI’s API using our own OpenAI key, which does not use your data for training or distribution, ensuring confidentiality.
Security: We rely on Forge’s industry-leading encryption and access controls to protect your data at all times.
Intellectual Property
Our IP: The App, including its code, design, and AI integration, is owned by Rogue Wombat Software and protected by copyright and other intellectual property laws.
Your IP: You retain ownership of your Jira data and any release notes generated. We claim no rights over your content beyond what’s needed to provide the App’s services.
Termination
By You: You may terminate use by uninstalling the App via Jira, deleting all data from Forge Storage.
By Us: We may suspend or terminate your access if you:
Violate these Terms.
Fail to maintain an active paid subscription.
Misuse the App in a way that harms us or others.
Effect: Termination ends your license to use the App, and all data in Forge Storage is deleted upon uninstallation.
Disclaimer of Warranties
We provide the App "as is" and "as available," leveraging Forge’s secure platform. However:
We do not warrant that the App will be uninterrupted, error-free, or meet all your needs.
OpenAI’s API performance is outside our control—availability depends on their service.
Limitation of Liability
To the fullest extent permitted by law:
We are not liable for indirect, incidental, or consequential damages (e.g., lost profits, data loss) arising from the App’s use.
Our total liability is limited to the amount you paid for the App via Atlassian Marketplace in the preceding 12 months.
This does not limit liability for gross negligence or willful misconduct where prohibited by law.
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or losses arising from your misuse of the App, violation of these Terms, or infringement of third-party rights, except where caused by our negligence.
Changes to These Terms
We may update these Terms to reflect changes in the App, legal requirements, or subscription policies. Updates will be posted here with a revised "Last Updated" date and communicated via the App or Marketplace listing. Continued use after changes constitutes acceptance.
Governing Law
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles. Disputes will be resolved in the courts of New South Wales, Australia, subject to applicable law.
